Reader’s Question:

I received a traffic violation in Idaho but I am a resident in Oregon. Will this be sent back to my driving record in Oregon?

Michael

Portland, OR

Oregon and Idaho are both members of the Drivers License Compact (DLC) so the ID ticket infraction will be reported back to Oregon’s Department of Transportation.

Moving violations stay on Oregon driving records for approximately 10 years from the conviction date, according to Department of Motor Vehicle. Oregon does not operate on a point system for traffic violations, so points will not be assigned for Idaho moving offenses.

You can contact the OR DOT to get more information about how they handle out of state tickets, specifically your offense from Idaho, and if the specific violation you were cited for would go on your Oregon driving record if you are convicted of it in ID.

Reader’s Question:

I would like to know if Oregon have an alcohol exclusion law?

Karen

Eugene, OR

Alcohol exclusions within insurance policies allow insurance companies to deny coverage to those injured while under the influence of alcohol. Exclusions can be used to deny payment to medical payments to hospitals and doctors. Some states laws is requiring proof only of alcohol use prior to injury and others being more require proof of a causal relationship between the injury and the use of alcohol.

From my understanding Oregon now prohibits insurance companies from using alcohol exclusions. Since legislature and court rulings vary by state, to check the exact status on alcohol exclusion and what the recent changes made to the Oregon Statutes lets say specifically regarding this concern, check with the Oregon Insurance Division. You may be able to research the issue by going through the Oregon Legislature site.

Reader’s Question:

Im am licensed in FL but Im planning to go to school in OR. Can I get my insurance in Oregon and will not change the registration address of my vehicle?

Linda

Thank you for asking Linda.

You will need to provide the insurance provider your new mailing address and the principal address where your motor vehicle will be garaged. you may then need to get new insurance in that state with another insurance provider If your insurance company does not operate in the state where you will be attending college, .

State laws and regulations differ but normally you are able to get insurance for your motor vehicle, while you stay out of state as a full time student without changing your registration in Florida or driver’s license to Oregon issued registration or license.

You may contact the OR Department of Motor Vehicles if you do need to change your registration or license to Oregon issued ones.

Reader’s Question:

Is it true that the state law in Oregon can only go back 3 years on your record? Thanks

Tommy

Thank you for asking Tommy.

The Department of Motor Vehicles for Oregon maintains motorists driving records.all convictions for traffic violations and crimes, suspensions, revocations and cancellations of your driver’s license are all included in your driving record.

When deciding or determining your insurance rate, an insurance company can only use the last three years of your driving record according to the Oregon law.

If it has been more than 3 years since your last moving violator or accident, you may qualify for your premiums to be lowered. To get more information what exact Oregon law or statute is regarding your motor vehicle record being looked back at by insurance providers, try contacting the Insurance Division of the Oregon Consumer and Business Services.

Reader’s Question:

I have a license and insurance in VT . I got involved in an accident but during that time my insurance was lapsed so I just want to know what will happen and what should I do? the other car was totaled and the accident happened in Oregon.

Harry

Thank you for asking Harry.

Driving without insurance is considered a class B traffic violation in Oregon. Oregon has a mandatory insurance law which requires every driver to insure their vehicle.

Driving without the mandated liability insurance may result in fines and suspension of your drivers license. If you are caught driving without insurance and are involved in a an accident, your driving privileges will be suspended for 1 year. After the suspension period ends you will have to carry an SR-22 for 3 years. If you were at fault in the accident then you likely also be held responsible for the damages you caused to the other party.

Since you have a Vermont license and registration the penalties might be a little different but probably just as severe.

Since you have a lapse in your VT car insurance you may verify with the Vermont Department of Motor Vehicles to know if your registration and/or driver’s license have not been suspended.

Reader’s Question:

I received a ticket while driving in Oregon. I have a CA license and I just want to know what I should do to take this off my record? Will going to traffic school help? I need to find the cheapest car insurance in the state of Oregon…I am a college student! Help!
Richard

Thank you for asking Richard.

Oregon and California are part of the Drivers License Compact so this means if you plead guilty to the Oregon speeding ticket and pay the fine, the traffic violation will be reported to the California Department of Motor Vehicles.

If the traffic violation is reported to your home state, the out of state points list would be 1 point on your CA driver’s license. It does not show that California would permit you to take a CA traffic school to clear the violation from your record since the offense took place out of state.

To check if you can take an Oregon traffic school, you may contact the county court of the area in which you received the ticket. Some counties in Oregon allow for traffic school for traffic violations while others do not. For example Douglas County does not use or offer traffic schools while Josephine County does.

Reader’s Question:

I am a mailman and I got a DUI and Im required to get sr22. What do I need to do since I need to drive to work? Am I going to be covered by my company’s insurance while Im at work? Im in Salem Oregon, going to college……had way to much fun at a party and got in trouble :) .

Gene

Thank you for asking Gene.

According to the Oregon DOT site an SR-22 is a certificate from an Oregon-licensed insurance company certifying that you have purchased liability insurance that meets the minimum required limits of coverage.

The OR DMV requires that your insurance company file an SR-22 certificate with DMV if, for example:

* You failed to provide proof to DMV that you have liability insurance,
* You’ve been convicted of driving without insurance,
* You’ve been involved in an uninsured accident,
* You are applying for a hardship or probationary permit, or
* At the time of reinstating your driving privileges following a DUII suspension.

It seems that Oregon State is requiring you to carry the SR-22 to reinstate your license after a DUII suspension. Oregon law requires you to keep a SR-22 in effect for 3 years from the ending date of a suspension which requires an SR-22 or for 3 years and 33 days from the date of a driving uninsured conviction.

As for your work, you will need to contact your employer’s insurance provider as well as your own insurance company to make sure you are properly covered for driving it with your current situation. You will need to check with them to get a definitive answer since insurance companies guidelines and terms of policies differ.

In Oregon, a mandatory insurance law requires every motorist to insure their motor vehicle. If you drive without insurance or if youre unable to provide proof of auto insurance to a law enforcement officer when requested, is considered a class B traffic violation in Oregon. .

If you drive without the mandated liability insurance in Oregon , you may face penalties such as suspension of your driving privileges ,fines of up to $300 and in some areas your vehicle can be towed. Cheap Car Insurance In the state of Oregon

Reader’s Question:

I received a speeding ticket while driving in the state of Oregon but I live in Canada. Should I just pay the fine? Will this be reported back to Canada? Should I buy cheap short term auto insurance while I am staying in Oregon?

Mike

Thank you for asking Mike.

All provinces in Canada have a reciprocal agreement with Ontario regarding traffic infractions. The Ontario courts or MTO share Ontario traffic tickets with Michigan and New York. She said they may still inform licensing agencies of other states that were not reciprocal states but she couldn’t confirm if it was done regularly for any states other than MI and NY.

Once speeding ticket that you received is placed on your Ontario, Canada driving record, then your insurance provider could see if the next time they pull your MVR and therefore your insurance rates may be affected.

Driver must always comply with a traffic violation by either paying the fine or fighting it in court. If you do not take care of a ticket that is received out of state there is the chance that the state that issued the citation will come after you and affect your license. In addition to that if you have a failure to appear on your record in this may affect your driving privileges in Oregon if you travel there again. If you do pay the fine after the court date the fine and court fees are likely to be higher than if you paid on time.

You may contact the Ministry of Transportation (MTO) for Ontario to get more information on how a ticket in Oregon could affect your license in Ontario.

Goodluck!
